INTRODUCTION

OTE - TELECOMMUNICATIONS S.A. (OTE) created the website at www.frogmobile.gr to provide information and services to the users. The use of www.frogmobile.gr is governed by these Terms and Conditions, and users are requested to read them carefully and comply therewith. The use of www.frogmobile.gr shall be construed as unconditional acceptance of these Terms and Conditions.
Minors are not allowed to use the websites and services of www.frogmobile.gr, which, according to the law, are intended exclusively for adults. However, in the event that minors voluntarily visit webpages or use services that may be considered inappropriate for them, OTE shall bear no responsibility.
OTE reserves the right to amend these Terms and Conditions at any time and without notice, but it also undertakes the obligation to update this text in relation to any such amendment or addition.
In the event that the use of any service of www.frogmobile.gr is regulated by special terms of use, these terms shall be considered to be part of these Terms and Conditions. However, in the event of a conflict, the special terms of use of each service shall prevail.

CONTENT – LIABILITY OF OTE

The website at www.frogmobile.gr is used "as is" and users are not able to make any modifications or other interventions. OTE shall make every possible effort to ensure that www.frogmobile.gr is safe to use and to provide it with accurate, complete, valid, reliable and up-to-date information. In any case, however, users acknowledge and accept that, given the nature and size of OTE's network, the latter may not be able to monitor all of the content and security of its webpages and services. For this reason, OTE shall not be bound nor does it provide any kind of guarantee nor assume any kind of responsibility with regard to the security and content of www.frogmobile.gr. Therefore, users accept that they must evaluate the content and that they are responsible for any risk that may

USER OBLIGATIONS

Excluding any specific third-party rights (intellectual or other), all the content contained on www.frogmobile.gr at any time (indicatively: trademarks, distinctive marks, photos, texts and all files in general) shall constitute the intellectual and industrial property of OTE, and it shall be protected by the relevant provisions of the Greek, European and international legislation. This content may not be traded, copied, modified, reproduced, retransmitted, transmitted or distributed, in whole or in part, by any user in any way. Each user is entitled to individually save a single copy of part of the content at www.frogmobile.gr, strictly for personal use and without erasing the indications of its origin.
Any third-party products and/or services that appear on the pages of www.frogmobile.gr shall constitute the intellectual and industrial property of such third parties, who shall bear any relevant liability for the content, services and/or products.
Users accept, agree and conclude that they shall use the website at www.frogmobile.gr in a lawful and appropriate manner, subject to, among others, the legislation concerning the transmission of data from Greece to EU Member States and third countries. Therefore, users - by way of example and not as a limitation - agree that they shall not use www.frogmobile.gr to: - cause harm to minors; - transmit or gain access to content that: i) violates any third-party rights (e.g. intellectual and industrial property rights), ii) offends the personality of third parties (e.g. defamatory, racist), iii) goes against the law and fair dealing practices, iv) violates the privacy and the individual and social rights of third parties in any way; - mislead anyone as to the origin of the content at www.frogmobile.gr; damage, in any way, the reputation of OTE or third parties; compromise the security of the OTE network; prevent any user from accessing www.frogmobile.gr or bypass OTE’s authentication check; - install and promote, in any way, any kind of unsolicited or unauthorized advertisement or unsolicited electronic messages (spam), chain mail, pyramid schemes and any other form of unsolicited content promotion, as well as install and promote advertisements without OTE’s written consent; - install, promote and/or publish content that contains digital viruses or any other electronic code, files or programs designed to interfere with, destroy or restrict the operation of any software or telecommunications equipment, or prevent other users from using www.frogmobile.gr; - disclose information about themselves or third parties containing personal data of users or third parties, either in real-time conversations (chats, message boards) or when using any service of www.frogmobile.gr that enables communication between more than two users. In the event of unlawful use of www.frogmobile.gr or use that violates these Terms, users shall be required to compensate OTE for any actual losses and loss of profits. In the event that OTE does not exercise its rights arising from these Terms, this shall not be deemed as a waiver of these rights.

PASSWORDS

For accessing certain services or connecting to certain websites, OTE may request user information in order to grant a relevant Password. The above data must always be true, accurate, valid and complete. Users shall be responsible for all actions carried out with the Password and must notify OTE immediately in the event of any unauthorized use thereof, as well as any (even potential) security breaches. OTE does not disclose this data to third parties. OTE shall not be responsible for any harm or damage that may be caused due to the arbitrary or illegal use of the Password by third parties, due to the Password being leaked or for any other reason, and it reserves the right to request compensation from the user in the event that is suffers any kind damage due to such arbitrary or illegal use of the Password. OTE has a right, at any time, to refuse to grant a Password or to cancel a granted Password or to terminate the provision of these services to the user and to refuse any current or future use of www.frogmobile.gr, in the event that the Terms of Use have been violated.

NETWORK AVAILABILITY & SECURITY

OTE shall make reasonable efforts to maintain and ensure the availability of www.frogmobile.gr. Nevertheless, users accept that OTE has a right to modify and/or temporarily or permanently interrupt all or part thereof, with and/or without notice to the users, given that availability may be affected by the users' equipment, other communication networks, the large number of people trying to use www.frogmobile.gr at the same time or for other reasons. Therefore, OTE shall bear no responsibility for any kind of loss (actual loss, loss of profit, through negligence, intra-contractual or other) arising from the use of www.frogmobile.gr or the users’ inability to access the website, the disruption of the whole website or parts thereof, the delay, non-delivery, interruption or poor quality of its services or any loss of content and the existence of any type of errors. In any case, OTE reserves the right to temporarily or permanently cease the operation of the entire website at www.frogmobile.gr or part thereof, for the purpose of maintaining or upgrading it or for any reason.
Although OTE shall make every possible effort to protect www.frogmobile.gr against digital viruses, it cannot guarantee that it will never be infected by viruses (virus free). Therefore, every user must take steps to ensure their own protection (use of antivirus software, virus scanners or other protection systems) before using www.frogmobile.gr or storing information, software or content from the website on their computers.

PERSONAL DATA

The "PROTECTION OF PERSONAL DATA" shall apply to the protection of personal data and the retention of customer content, as this is laid down at www.cosmote.gr/dataprivacypolicy/notices. OTE shall not be responsible towards users for any leakage of their personal data due to their own use of third party products and services through the website at www.frogmobile.gr.
Any responses to polls that may be conducted on www.frogmobile.gr shall be recorded, analysed and commented on by OTE, which reserves the exclusive right to use this data, and any relevant findings shall constitute OTE’s intellectual property.

OTE may use cookies to identify users. APPLICABLE LAW – JURISDICTION

These Terms and Conditions and any amendments thereto are governed by Greek Law. The courts of Athens shall have jurisdiction on any disputes that may arise from this Agreement.
